1. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Site or to engage us for any brokerage services. By using the Site, you represent that you meet these requirements.

2. The Site and our services

The Site provides general information about Vinny The Watch Guy and a way for you to contact us regarding sourcing, buying, selling, or trading wristwatches. The Site is informational; any transaction is governed by a separate written agreement between you and Wingspiration, Inc. covering the specific watch, price, payment, delivery, and warranties.

Watch listings, prices, photographs, and availability shown or referenced on the Site are subject to change at any time without notice and do not constitute an offer. Nothing on the Site creates an obligation on either party to enter into a transaction.

3. Inquiries and information you submit

When you submit information to us through any form or communication channel, you represent that the information is accurate and that you are entitled to share it. You are responsible for the content of any photographs, descriptions, or other materials you submit, and you grant us a non-exclusive, royalty-free license to use those materials solely to evaluate and respond to your inquiry.

4. No financial or investment advice

Information on the Site is provided for general informational purposes only and is not investment, financial, tax, or legal advice. Wristwatches are not securities, and we make no representation that any watch will appreciate in value. You are solely responsible for your purchasing, selling, and investment decisions.

5. Intellectual property

The Site, including its text, graphics, logos, images, and source code, is owned by Wingspiration, Inc. or our licensors and is protected by copyright, trademark, and other laws. The names “Vinny The Watch Guy” and “Wingspiration” and any associated marks are our property. Brand names and trademarks of watchmakers referenced on the Site (e.g., Rolex, Patek Philippe, Audemars Piguet) belong to their respective owners and are used for identification only. Their inclusion does not imply endorsement, sponsorship, or affiliation.

You may view and print pages of the Site for personal, non-commercial use. You may not reproduce, modify, distribute, or create derivative works from the Site without our prior written consent.

6. Acceptable use

You agree not to:

• Use the Site for any unlawful purpose;
• Attempt to gain unauthorized access to the Site or any related systems;
• Interfere with the Site’s operation, including by introducing malware or excessive automated traffic;
• Submit false, misleading, or fraudulent information;
• Use the Site or any communications from us to launder funds, evade sanctions, or facilitate any illegal activity.

7. Third-party services and links

The Site embeds forms hosted by Watchtrack and links to third-party platforms (including social media). We are not responsible for the content, terms, or privacy practices of third-party services, and your use of them is at your own risk and subject to their terms.

8. Disclaimers

THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Any specific warranty regarding a watch you purchase from us (including any authenticity guarantee) will be set out in the written agreement governing that transaction. Nothing on the Site constitutes a warranty for any specific watch.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WINGSPIRATION, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SITE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100), OR, IF GREATER, THE AMOUNT YOU PAID TO US (IF ANY) FOR THE GOODS OR SERVICES THAT GAVE RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify and hold Wingspiration, Inc. and its officers, directors, employees, and agents harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of or related to your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party.

11. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts.

12. Changes to these Terms

We may revise these Terms from time to time. Revised Terms will be posted on this page with a new “Last Updated” date. Continued use of the Site after revisions are posted constitutes acceptance of the updated Terms.

13. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. These Terms, together with any separate written agreement we sign for a specific transaction, constitute the entire agreement between you and Wingspiration, Inc. regarding the Site.
